Beta Terms and End-User License Agreement

These Beta Terms and End-User License Agreement (the “Terms”) are an agreement between you and Murchie Ewings, the publisher of SkimSpeak (“SkimSpeak,” “we,” or “us”). By checking the acceptance box and downloading, installing, or using the private-beta software, you agree to these Terms. If you do not agree, do not download or use SkimSpeak.

1. Who may use this beta

This release is an invited, friends-and-family evaluation for people in the United States who are at least 18 years old. It is not a general consumer release. You may not use the beta with protected health information, regulated data, third-party confidential material, or any text you are not authorized to transmit through the SkimSpeak Beta relay. We do not offer a business associate agreement, data processing agreement, uptime commitment, or support SLA.

2. Limited license

We grant you a personal, limited, revocable, non-exclusive, non-transferable license to run one copy of this beta on Apple-branded computers you own or control, solely for evaluation. You may not redistribute, rent, lease, sell, sublicense, or make the app available to others; bypass access or usage limits; remove ownership notices; or reverse engineer the app except to the limited extent applicable law does not permit that restriction. Open-source components remain governed by their own licenses.

3. The current build and future releases

The build you lawfully download may provide included Beta access as implemented in that build. Your download does not promise access to future versions, hosted service, support, features, or pricing. Future distributions and versions may use different features, limits, eligibility, license terms, or pricing.

You may retain a lawfully obtained build subject to these Terms, but an old or skipped build may become unsupported, incompatible, insecure, or unable to reach third-party services. We may require an update for continued access to a SkimSpeak-hosted service. Material new terms will be presented prospectively; they do not silently rewrite rights already granted for a downloaded build.

4. Included Beta access

While capacity lasts, an eligible installation may receive up to 100 summary requests during a seven-day Beta window. This access has no cash value, may end when used or expired, and may be suspended to control security, abuse, provider cost, or capacity. Counts can include a request reserved before a provider failure.

5. AI output and consequential use

AI-generated summaries may omit, misstate, or distort important details. The original text is authoritative. Review it before relying on a summary, especially for medical, legal, financial, safety, or other consequential decisions.

Spoken playback may pronounce or convey names, numbers, punctuation, abbreviations, and formatting imperfectly. Check the written original before quoting, sending, or relying on what you heard.

A summary is an automated approximation, not professional advice or a substitute for the source. Do not use SkimSpeak as the sole basis for medical, legal, financial, employment, safety, emergency, or other high-impact decisions. You are responsible for checking the original and exercising independent judgment.

6. Your text and acceptable use

You retain rights in text you supply. You represent that you have permission to process it and authorize SkimSpeak to perform the processing you select, including sending redacted copied text through the Beta relay for summarized modes. Do not use the app unlawfully, to harm others, to probe or overload the service, or to evade technical protections. The 100% verbatim mode is designed to remain on the Mac; summarized modes involve external processing as described in the Privacy Notice.

7. Privacy and third-party services

The Privacy Notice describes the app’s data flows and is part of these Terms. Apple, Cloudflare, OpenRouter, Groq, upstream model providers, and other third parties may apply their own terms and privacy practices. SkimSpeak does not control or make promises for them.

8. Updates, availability, and support

Update checks may report a newer version, but updates are not guaranteed. You may skip an optional update, understanding that we may support only the current version and may discontinue the beta or hosted Beta access at any time. During this private beta, contact the person who invited you for support. Do not send sensitive source text or credentials in a support message.

9. Ownership and feedback

SkimSpeak and its non-open-source software, branding, and documentation belong to the publisher and licensors. If you voluntarily provide feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without identifying you or creating an obligation to you.

10. Ending access

You may stop using and delete the app at any time. Your license ends if you materially breach these Terms. We may revoke hosted Beta access for abuse, security, legal, provider, cost, or capacity reasons. Sections that by their nature should survive—including ownership, disclaimers, liability, and disputes—survive termination.

We are not accepting payment under this private-beta agreement. If SkimSpeak later offers a paid subscription or license, the checkout terms will state its price, billing period, renewal, service period, cancellation, and refund rules before purchase. Our intended baseline is that cancellation stops the next renewal and paid access ordinarily continues through the already-paid month or year. We will honor legally required refunds and may consider additional hardship requests case by case, without promising an exception in every situation.

14. General terms and changes

If a provision is unenforceable, the remainder stays in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them with the product or business. Applicable mandatory consumer protections continue to apply. These Terms and the Privacy Notice are the entire agreement for this private beta.

We may change these Terms for a future distribution or hosted service. The effective date above identifies the version you accepted. During the private beta, questions should go to the person who invited you; a permanent support address will be published before a paid public offering.
